Terms of Service

These Terms govern use of Chatly, a WhatsApp commerce platform operated by Vularis (Pty) Ltd ("Chatly", "we", "us"). By using Chatly you agree to these Terms.
1. Service
Chatly enables businesses to receive orders and send payment links and confirmations to their customers over WhatsApp, using the WhatsApp Business Platform and our payment processor, Paystack.
2. Acceptable use
You agree to use Chatly only for lawful purposes and in compliance with the Meta Platform Terms, the WhatsApp Business Messaging Policy, the WhatsApp Business Commerce Policy, and all applicable South African laws. You must not send spam or unsolicited messages.
You must not use Chatly to sell, promote or take payment for anything the WhatsApp Commerce Policy prohibits, including: firearms, ammunition and weapons; illegal, recreational or prescription drugs; adult products and services; dating services; gambling; loans, investment schemes, cryptocurrency or currency; fake documents, counterfeit or stolen goods; body parts or protected wildlife; or goods and services that are fraudulent or misleading. Alcohol, tobacco and vapes, supplements and health claims, live animals, and digital subscriptions are restricted and may be refused.
Chatly screens products, payment descriptions and business names against these rules. We may refuse or remove a product, hold it for review, and suspend an account that breaches them — including when Meta restricts or disables your WhatsApp Business Account. While suspended you keep access to your own data, but cannot take orders or payments. Contact support to appeal.
3. Accounts and credentials
You are responsible for the WhatsApp Business Account you connect and for the accuracy of information you provide. You authorise Chatly to send and receive messages on your behalf as needed to provide the service.
4. Payments
Payments are processed by Paystack. Chatly is not a party to the underlying transaction between a business and its customer.
5. Liability
Chatly is provided "as is" without warranties. To the extent permitted by law, Vularis (Pty) Ltd is not liable for indirect or consequential damages.
6. Changes
We may update these Terms; continued use after changes constitutes acceptance. See also our Privacy Policy.
